Electronic Transactions and Electronic Records Consent

1. Overview and Scope of Consent

Under this E-SIGN Agreement, you are asked to consent to two primary matters:

• Conducting transactions with XtraFleet through electronic means; and
• Receiving all agreements, disclosures, notices, communications, and records relating to the XtraFleet Services in electronic form rather than on paper.

Please read this E-SIGN Agreement carefully and retain a copy for your records.

2. Use of Electronic Methods for Transactions

By clicking "Yes," "Consent and Continue," or a similar acknowledgment within the XtraFleet Services, you agree that:

a. Electronic Transactions

You and XtraFleet each have the right to conduct any transaction relating to the XtraFleet Services or the XtraFleet Web App using electronic methods.

b. Optional Alternative Methods

From time to time, either you or XtraFleet may elect to conduct a transaction using an alternative method (such as orally over the telephone). Any such alternative method does not modify, limit, or revoke this E-SIGN Agreement or your consent to transact electronically.

3. Consent to Receive Electronic Records

By providing your consent, you agree to receive all agreements, disclosures, notices, receipts, statements, and other communications relating to the XtraFleet Services (each, an "Electronic Record") in electronic form.

You specifically acknowledge and agree that:

• XtraFleet may provide any Electronic Record to you electronically and is not required to provide paper copies unless expressly stated otherwise;
• Your electronic signature has the same legal force and effect as a handwritten signature on a paper document;
• Electronic Records may satisfy any legal requirement that information be provided to you in writing, including disclosures of legal rights and obligations;
• You have access to the hardware and software requirements described in Section 6 below and are able to access, receive, and retain Electronic Records; and
• You are responsible for maintaining accurate and current contact information so that XtraFleet may communicate with you electronically.

Electronic Records may be delivered to you via email, through links included in email notifications, through your XtraFleet Account, or through other electronic means made available within the XtraFleet Services.

Delivery of an Electronic Record has the same legal effect as delivery of a paper document, regardless of whether you choose to view or access the Electronic Record.

4. Obligation to Maintain a Current Email Address

• You agree to provide and maintain a valid, accurate, and current email address and any other contact information requested by XtraFleet.
• You must promptly update your contact information if it changes. XtraFleet is not responsible or liable for any failure to deliver Electronic Records resulting from outdated or inaccurate contact information.
• If XtraFleet sends an electronic communication to the email address on file, such communication will be deemed delivered. XtraFleet has no obligation to re-deliver returned or undeliverable messages unless and until you provide updated contact information.
• If your email address becomes invalid, XtraFleet may deem your account inactive and suspend access to the XtraFleet Services until the information is updated.

5. XtraFleet's Right to Provide Paper Records

Notwithstanding this E-SIGN Agreement, XtraFleet reserves the right, in its sole discretion, to provide a paper copy of any document. Unless XtraFleet expressly agrees otherwise, you may not substitute a paper record for any Electronic Record.

6. Hardware and Software Requirements

To access and retain Electronic Records, you must have:

• A smartphone, tablet, laptop, or computer with a supported operating system;
• Internet access;
• A supported, current version of a web browser with cookies enabled;
• A valid and current email address; and
• Software capable of viewing PDF files.

"Current Version" means a version of software currently supported by its publisher and by XtraFleet. XtraFleet may discontinue support for any software version at any time for security or operational reasons.

7. Revoking Consent to Electronic Records

Your consent remains effective until withdrawn.

You may revoke your consent to receive Electronic Records by:

• Using the "Contact Us" feature within the XtraFleet Web App; or
• Submitting written notice to:

Revocation will become effective only after XtraFleet has had a reasonable opportunity to process your request.

If you revoke consent, you may no longer be able to use some or all of the XtraFleet Services, and XtraFleet may close your account in its sole discretion.

8. Requesting Paper Copies

You may request a paper copy of any Electronic Record at no charge within 180 days of its electronic delivery by contacting:

Your request must specify the document requested. A request for a paper copy alone does not revoke your consent to receive Electronic Records.

9. Acknowledgment

By clicking "Yes," "Consent and Continue," or a similar acknowledgment, you confirm that you have read this E-SIGN Agreement, understand it, and agree to its terms.
